So often the contracts our commercial insured’s are signing ask that they waiver subrogation.  What exactly does this mean and, more importantly, can our insured comply with this contractual request?  This topic will explore these “waivers” and look at some samples of current contractual waivers used in the marketplace today.  These requests will be compared to current ISO property, CGL and auto policies.  We will also explore the WC question of “why does a waiver of subrogation make absolutely no sense”?
